"Attorneys general from 22 blue states along with Washington DC and San Francisco signed a secret agreement just 3 days after President Trump won the 2024 election for a coordinated response to resist Trump's anticipated actions to end birthright citizenship.

According to an investigation by the Heritage Foundation's Oversight Project, the 22 AGs agreed to legal collaboration and communication to defy Trump's immigration enforcement initiatives, including any deemed confidential or privileged.

All shared information would be used to coordinate various legal schemes, as well as pre-lawsuit investigations, litigation strategies, complaints, dispositive motions, merits briefs, and amicus briefs. The agreement also bars third parties from accessing any of this shared information, which is defined as all documents, materials, information, and communications exchanged between the attorneys generals’ offices prior to the agreement. "

    So, they engaged in an interstate compact not approved by Congress?

    Article I, Section 10, Clause 3 (Compact Clause)

    “No State shall, without the Consent of Congress, … enter into any Agreement or Compact with another State, or with a foreign Power, unless actually invaded, or in such imminent Danger as will not admit of delay.”

    The courts have confirmed that if a compact affects federal supremacy or alters the balance of power between states and the federal government, Congress must approve it.

    Agreeing to impede and oppose federal immigration enforcement would fit that qualifier. Meaning unless Congress approves it, they are acting against the constitution.

    I am torn here. I always want to see the Federal Government have less power. Less Government = Better Government. With this said, isn't this collusion?

    Cut off all Federal money as long as they act as obstructionist.

    Fine. If those 22 states don't want to go along with the Feds, they don't have to. Of course, every damned one of those states has seen its last federal dollar. Don't want to play? Then you won't get paid. Simple as that.
