The problem I have in this case is that these judges aren't using any laws to nullify the EO - they're trying to claim that the bias in the EO nullfies it. The code of the statute, however, doesn't care what the bias is - it simply gives carte blanche discretion to the President. The judges are reading something into their interpretation which doesn't exist - anywhere - and using that as the basis for overturning the travel bans. It should get them a one-way ticket to disbarment.
While this is not the way it is, nor the way the Framers intended it to be, the courts have no authority by way of the Constitution to determine what is and isn't Constitutional, its something they granted themselves. The fact that today they are permitted this transgression is why they hold influence over society regardless of what society wants.
Capricious? Its the irrational liberal judges that are capricious.

Still sticking in me craw was the Kalifornia money helping to pay for ads the now an Alabama Senator Doug Jones used to defame Roy Moore, without any basis in fact comparing Moore to George Wallace as if the accusing women Gloria Allred trotted out wasn't bad enough.

This issue reminds me of a recent trip I made to Mexico. While boarding our plane in Dallas to Puerto Vallarta, the agent continuously insisted we have our passport in hand, not to inspect, but to ensure we had one. The agent also said that if we arrived in Mexico without a passport, we would be immediately "be sent back on the next plane out." The irony was inescapable.
It is NOT a law, they cannot rule on it.
And it violates the Presidents Right to control immigration.
