    There's just something deeply wrong when a cop on his own with no immediate review, or a prosecutor filing charges even before probable cause hearing can seize property including homes, cars, planes, furnishings, cash during a traffic stop, etc. and then rely on a lengthy, messy, and extremely costly process to dissuade a citizen from even trying to get it back. Even denying the use of a person's assets to use in his defense at trial, if the charges ever get to trial.

    And then to conclude as Norquist does: ""This is an assault on property rights," Norquist said. "It unites folks on the right and left, and it's one of those issues in the next several years that we can get something done." (emphasis added)

    How many lives can they continue to ruin in the next several years, and instead of get something done at that point sometime in the future, why not now. Or is this just another pandering bit to disappear after the next election as most of these types of responses are.

      It's an open-and-shut violation of due process, and any judge who upholds it has violated his oath. It is not possible to honestly believe differently.

    I think ALL fines and police confiscations should NOT go to the people doing the fining or confiscation. Its a plain conflict of interest. The way it is now encourages policing for profit.

    Sorry but any seizure of assets without a warrant is unconstitutional unless fair restitution is paid at the time (this allows for eminent domain which is not the subject here I think).

    "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

    Until ANY and ALL Ad-Valorm taxes are completely done away with YOU HAVE NO REAL PROPERTY RIGHTS!!!

    You are only "renting" from the Government, be it local, country state or federal.

    Most Ad-Valorem are local, county and state.

      Ad valorem apparently includes sales tax as well as property tax and inheritance tax. I would agree to sales tax as a reasonable method of funding a minimalist gov, but I totally agree with you, woodlema, about perpetually renting your property from the gov via property tax. That needs to GO!

        I have had to jump through all kinds of hoops to make our property taxes affordable. My bride and I have Galted on a 700 acre ranch in Texas far from any populated areas (my choice of where to buy said ranch was predicated on night time Sat pics observing the LACK of lights, ie, REMOTE), and to keep from being taxed to death we have had to resort to any and all tax exemptions available, currently offered by fed, state, and local govts, including ag exemptions, wildlife exemptions, soil conservation exemptions, blah, blah blah. All of which costs us money to comply. I wonder when, in my dreams, will we be offered school tax exemptions since we are in our 60's and have no kids, nor will we, since we are both now infertile. Where is THAT exemption?
        On top of that, ALL those exemptions, at the whim of cash starved govt thieves, can be eliminated with no real due process. So, there is no security regarding retirement planning .
        We have no real heirs that would appreciate our off grid life style, which is mostly mute, because even if they were deserving, they would have to sell off half the assets just to pay the effing inheritance taxes.
        I believe my final solution will be an automatic sequence of events that will be initiated upon the final demise of the last survivor, either me or my bride.

        I have the technology, in part trained by a govt destruction machine, aka, military.

    I would like to point out that many of these cases I read are happening in NM! If you live there I encourage you to contact your reps and senators. What a corrupt state! Do not galt there!

      Thanks for the warning. It is difficult to keep track of 'which' states are standing up for 'which' specific freedoms (whilst simultaneously crushing other freedoms). I keep hoping that one state will pull definitively 'ahead of the pack' in support of personal and economic freedom.

      I have been reading dire reports of mass graves in Mexico. Keep safe!

      NM actually passed a law about doing away with Civil Asset Forfeiture. It upset some, especially in Dona Ana County (Las Cruces area) in southern NM. That area is just north of El Paso, TX and Fort Bliss, but it is also where I-10 and I-25 meet, so it is a hot bed of drug and illegal trafficking.

    Without property rights, no other rights are possible. That is why police seizure of property without a hearing and the proper legal steps is not only unconstitutional, but immoral to the nth degree. It is especially egregious when prosecutors and judges help foster such actions. If the Founders were alive today, they'd need a lot of duct tape to keep their heads from exploding.

    Just in case you haven't noticed those charged with implementing the laws do so at their own discretion.
    This has been going on for years and years. We do not have property rights any longer unless we are otherwise towing the line. Towing the line means don't upset the apple cart i.e. the police who believe they are the ultimate authority because if you do buck them the judges will still support them regardless how right you are. Welcome to the USA.

    The answer was summed up on a bumper sticker I once displayed: You Own Your Property or You ARE the Property. But people would ask me what it meant.
    FWIW, our county Republican Party recently put civil asset forfeiture at the top of its issues priority list.

    The police can suspect all that they want...
    They are being paid to protect...not "enforce".

    I've heard it said that English Common Law states that your property is yours only for the span of your lifetime, then reverts to the state.

    Maybe someone who knows of this can chime in .

    The facts are, that you do not have property rights. Property taxes, HOA fees and other regulations have taken them from you. If can not pay the tax, HOA free, or fall in line with their regulations, the authorities have given themselves permission to steal your property.

    I don't think it's much of a stretch to think that the powers-that-be want a cash-less society. For our security, you understand. Think of the financial savings of not having to print that dirty money, not to mention the health benefits of not spreading disease with said unsterile money! Of course, the whole thing could be administered by the IRS, as they have so much experience keeping track of things.

    Remember the song "This Land Is Our Land?" It became very popular in the 60s. Check out the words on the Internet. This song's main theme is that there should be no private property. It is interesting to note that not until this year has any radio commentator explained this song/s true meaning.
