Our current president seems to think prosecutorial discretion allows him and his administration to choose which laws they will enforce or not enforce. I am not a lawyer; I have never attended ANY law classes, but I believe prosecutorial discretion involves a prosecutor deciding there is insufficient evident to try a PARTICULAR case and proceeding with a weak case would not represent the best use of public funds.
Every president swears an oath of office which includes,"...will to the best of my ability, preserve, protect, and defend the Constitution of the United States." That same Constitution in Article II, Section 2 states, "...he shall take care that the laws be faithfully executed." I do not see any wiggle room in this area at the highest executive level. How can President Obama justify HIS interpretation of prosecutorial discretion?
