I believe that this can be solved with common sense, but that makes too much sense for any kind of person that is working on this case.

Part of the problem is that prosecutors do not get and keep their jobs for insuring that justice is done. They get and keep their jobs by putting people in jail.

Definitely a case where prosecutorial discretion should have been applied. Lack of common sense on display in all its glory.
