The Posse Comitatus Act is a United States federal law (18 U.S.C. § 1385) passed on June 16, 1878 after the end of Reconstruction. The Act was intended to prohibit Federal troops from supervising elections in former Confederate states. It generally prohibits Federal military personnel and units of the United States National Guard under Federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. State personnel do not suddenly become federal personnel simply because they've been given military equipment. A local sheriff with an M-16 is still a local sheriff. He just has more firepower.
And the difference between a cop driving an armored truck and a soldier driving an armored truck is the level of government to which they answer. Law enforcement answers to the state government, while military answers to the federal government.
Though actually, a soldier could still answer to the state government, if they're in the National Guard.
Yeah, Tim McVeigh knew how to build a very, very powerful IED.
And that guy in the 1930s who blew up the school seemed to know how to build an IED. Dunno if he was a vet, though.
