If you don't like it walk away, if you lose business, thats your problem. If you don't like workers taking excessive breaks, limit their breaks or take it out of their pay. That is your right as an employer, those actions that you have a RIGHT to take are more active towards promoting a smoke-free workplace than stupid communistic laws.
What kills me is that they get away with it because secondhand smoke kills. They say you don't have a right to it because it doesn't just harm you it harms those around you. Last time I checked people can walk away from the smoke, not like a slight contact of walking by smokers is going to give you instant lung cancer.
Super big pet peeve of mine. Great example of why I HATE SCARE TACTICS in advertising. It promotes stupidity.
