I received the following email today. Clarifies the situation on the Muligan Mint.

Despite rumors to the contrary, Mulligan Mint, Inc. remains in operation in a Chapter 11 bankruptcy case. The Chapter 11 Trustee does not intend to convert the Mulligan Mint bankruptcy case to a Chapter 7 liquidation. It is the Chapter 11 Trustee’s intent to operate, take and fill orders, and rebuild the operations of Mulligan Mint to reorganize its business and/or sell Mulligan Mint as an operating, going concern entity. Please be advised, as set forth in the attached Order, that only the Chapter 11 Trustee or his agents have authority to speak for Mulligan Mint, and only the Chapter 11 Trustee has authority over its operations and property, even property for which title and ownership is disputed. Below is the Order Appointing Permanent Trustee, signed December 5, 2013

IN THE UNITED STATES BANKRUPTCY COURT
FOR THE NORTHERN DISTRICT OF TEXAS
DALLAS DIVISION
In re: MULLIGAN MINT, INC., Debtor.

CASE NO. 13-34728-sgj-11 (Chapter 11)

ORDER APPOINTING MILO H. SEGNER, JR.
AS PERMANENT CHAPTER 11 TRUSTEE

On the 18th day of November 2013, the Court considered the report of Milo H. Segner, Jr., who, pursuant to this Court’s prior order, was acting as interim chapter 11 trustee. After hearing Mr. Segner’s report, the Court determined that it is in the best interests of the estate for Mr. Segner to be appointed as permanent Chapter 11 Trustee over the bankruptcy estate of the Debtor, Mulligan Mint, Inc. for all intents and purposes.

IT IS THEREFORE ORDERED that Milo H. Segner, Jr. is hereby appointed the Chapter 11 Trustee for the Debtor’s bankruptcy estate on a permanent basis.

It is further ORDERED that as the Chapter 11 Trustee, Mr. Segner has all corporate authority over the Debtor’s bankruptcy estate, the same as a Board of Directors and a Chief Executive Officer, and is the only officer of the Debtor’s bankruptcy estate with authority (a) to hire and/or terminate any and all employees or independent contractors; (b) over any and all financial accounts, including, but not limited to, bank and PayPal accounts; and (c) over all property of the Debtor’s bankruptcy estate, including, but not limited to, property to which title may be disputed; and (d) over all information of the Debtor.

It is further ORDERED that all employees, officers, former employees and officers, independent contractors, and professionals have a duty to cooperate with the Chapter 11 Trustee and his professionals.

It is further ORDERED that this Order is enforceable by contempt pursuant to the Court’s inherent authority.
