Adam Mossoff shows that the attack on patents is based on false assumptions and is inherently Luddite economically.

    "Justice Anthony Kennedy stated as simple fact in eBay v. MercExchange that “An industry has developed in which firms use patents not as a basis for producing and selling goods but, instead, primarily for obtaining licensing fees.”
    From this quote, I sense from this quote that Justice Kennedy does not understand the amount of work associated with inventing something. He seems to assume that the value is in producing and selling stuff, and innovation is just a tangent ot that. The world is going the opposite way. Producing stuff is easy. The value is in the innovation.

    If one can patent an idea and "own" it, then one can sell that right to others to serve in their stead. What's your point?
