I'm Judge Andrew Napolitano, Senior Judicial Analyst for Fox News Channel, and New York Times best selling author.     Are there any countries out there, in your opinion, that do a better job than the USA in respecting and protecting natural individual freedoms? While I am not yet ready to emigrate, there may come a day when those of us who cherish freedom see no better alternative, as much as that pains me to say...

    I'm not sure how much personal latitude you get at Fox, so how much would you like to say that might bring up contractual issues?

    Mine is a legal question. How can you change in midstream the legal definition of a word that has been defined in the law dictionaries for at least a couple hundred of years? These definitions are used by law makers so that the clear intent of the law is understood. Who knows how many of thousands of laws were made using that specific term and what impact it could have after you change the meaning. Would it not make all previous laws using that term null and void or, at best, that none of them would apply going forward after the change, IE: none of the previous laws would apply to anyone who gets "married" after the definition change?

    Hypocrisy was at its finest when the folks in congress said that the Georgian people should be able to decide for themselves their destiny and not Russia. Yet we are not allowed this privilege here in the states. If you agree that we will have sections of the country to secede when do you think that this will happen and how it will come about.

    The immigration issue splits Libertarians, to a certain extent - free flow of labor versus 'how can you have open borders and a wide-open social safety net.' What are your thoughts on immigration, and where do you think most libertarians fall on this issue?

    With impending Republican majority in Congress, ostensibly by those elected largely on the basis of conservative values, what are the mechanisms and chances for replacement of Republican House and Senate leaders who continue to undermine the values of the voters?

    On March 21st 2010 Congress passed the affordable care act. The act mandated that all insurers provide free preventative health services to their customers, however the decision of which services counted as 'preventative' was left up to the secretary of the HHS. Is this practice of congress leaving major legislative decisions in the hands of the president and his staff common? Should we expect to see more of it?

    Is the multi-state compact to award all electoral votes to the winner of the popular vote, regardless of the individual state's vote, Constitutional or not?

      The constitution doesn't specify how the electors within a state are to vote other than (by amendment 12) they are to vote for POTUS and VPOTUS specifically.
      Because it is silent on that subject, however the state or it's electors decide to vote is entirely up to them.

      Indeed, the Constitution doesn't specify how to choose electors: "Each State shall appoint, in such Manner as the Legislature thereof may direct...".

      In essence the "popular vote" is merely a tool we sue to try to bring a sense of "we did this" to the process. In truth the electors are, by U.S. constitution, allowed to vote for whomever they want. Frankly, if a state wanted to have their Governor appoint the electors that would not be in opposition to the rules of the U.S. constitution, so long as the appointment was done on election day.

      Wouldn't that be fun, though? If one or more states decided to do that?

      You'll want to repost them on this post OA (we don't want the judge to waste any time surfing around the Gulch to find the questions). Also, you should post each question as an individual comment so they can be voted on by other members. There's no limit to the number of questions you can ask. Thanks.
