Judge In Planned Parenthood Trial Orders Guilty Verdict Against Journalist

Why have a jury when the judge will make the decisions for the jury ahead of time? And, if these videos were made at hotels, restaurants, etc as the defendant states, then how is this trespassing? If this is the standard - then law enforcement and journalism in general will have a new set of standards to meets as they do undercover work all the time. Having real information out there - especially for the taxpayers, who not only have their money stolen from them in the first place, but to know it is being used is important. I agree with the defense in this case that this judge seems biased.

    What a clever way to guarantee that this is overturned on appeal, while avoiding giving AntiFA punks an excuse to chase him down.

      Ahh... Maybe you are right. But that is hard on the defendant to have to put out more time/money to go that route.

      The judge should have done the right thing and threw it out or let the jury decide. If the jury decided the same, or let the defendant off, the judge could blame it on the jury and still claim he's "one of them".

        If we lived under a just regime, then no prosecutor would have taken up this case.

        The primary value is the exposure of crime. The secondary value is the privacy of the criminal.

        In this case, the ranking of the values is upside-down.

        It's almost as weird as in that bizarro parallel universe, where Spock doesn't have a goatee, and Kira doesn't wear a leather catsuit.

        A judge can always opt to toss a lawsuit out of court as frivolous. Me dino considers the subject at hand to be the same. How can you harm a baby abortion mill by telling the truth about it?
        During my 21 years as a state corrections, three times as many prison inmates tried to sue me and three times a federal court judge tossed the phony complaint.
        What kind of cases against me were they? The last one was an inmate who kicked me in the butt while I was struggling with another inmate (who took a baton from another officer another inmate was beating up) and then sued me for writing him up and keeping him from going to work release.
        The only time I was ever called to court was as a witness. As a back gate tower officer of the day, I wrote an incident report about how an officer had to physically remove an inmate from my sally port by laying his hands on him to force him fully back inside the prison. The inmate falsely claimed he had been beaten up.
        Me dino was never even called to the witness stand yet thoroughly enjoyed myself. What a great change of pace and I was making as much money as I would working with inmates in that stinking prison.
        Reminds me of the time when at the prison a captain apologized for making me wait on my butt in a chair for over an hour in his nice air conditioned office. I said, "That's okay. I'm still being paid."

    Well, this was the statement:

    "“I have already determined that these defendants trespassed at each of these locations. Because I determined that these defendants trespassed, the law assumes that Planned Parenthood has been harmed and is entitled to an award of nominal damages such as one dollar for each trespass,” he told the jury as the trial comes to a conclusion.

    The judge said he had also determined that Daleiden and his colleagues trespassed at the Planned Parenthood Rocky Mountain Center in Colorado and a Planned Parenthood Center in Texas."

    The judge can't do that. That is not his function. Whether you agree with abortion or not, selling baby parts is illegal, very illegal. Yet, the demonrats and pre-trump presidents have supported it and funded PP, in exchange for big money donations. Your tax dollars at work, and they get the joy of knowing you gave to the demonrats. PP should have been banned the day after it was started, simply because it is all fakery. The abortion thing is just another tool of the deep state to funnel money, just like every war has been.

    I started to read about this. I got as far as "a jury in California" and knew that I had read everything I needed to for a full understanding of what happened here.

    The guy in the WH uses the term "Rigged" all the time. If this isn't proof positive I don't know what is.
    Depending on the charges and what side of the political spectrum it effects, all you need to do is shop for the right judge. I believe that any judges ruling that gets overturned in a higher court, the defendants should have their legal expenses reimbursed.

    Probably the most interesting thing in this entire case is the complaint itself. If you look carefully, PP didn't go after them for libel (because they reported the truth from the mouths of PP's own staff). They didn't go after them for violations of consent, because in the states involved they were either in public places where consent is automatically waived or in one-party consent states. No, PP went after them for trespass.

    Yeah, look for this one to be overturned on appeal. This order by the judge on how the jury must rule is ridiculous - as is the based complaint.

      Interesting. I am not a lawyer and can't claim to be highly familiar with the courtroom - but it seems like taking the decision away from the jury is an open door to activist judges and circumventing the premise of "justice". May as well eliminate the jury and let the judges make all the decisions. This would save a lot more time and money - but I wouldn't want to end up in front of judges in that case though.

    The "journalist" (who was not unbiased so doesn't deserve that label) lied about who he was to get into a private meeting. I have no problem with the verdict. But the judge did wrong in ordering it, and if any jury member objects I hope they'll speak up and try to nullify it.

    @Lucky: I like the English system but it has the major advantage of allowing private prosecution. In most cases in the US, no prosecutor wants to pursue the person who obtained the evidence. This case is a rare exception.

      I cannot find anywhere in the article or on here where anyone said the Journalist was unbiased. The article called him an activist Journalist.

      So again, does that mean that the mainstream Journalists that do undercover stories (by using false stories to gain access) or police doing undercover investigations should then also be able to be prosecuted for trespass and then in the ones caught in turn be awarded a fortune for simply having their own words exposed? Based on that approach - no one will ever be able to catch smart criminal operations so long as they stay behind closed doors to do their dirty work.

        I'd rather have that situation than one where nobody's proprietary data is safe.

        And the vast majority of cases I've seen involving this type of infiltration are of industries such as meat farming, which the vast majority of us consider perfectly legitimate. Yes, some gross looking scenes occur during butchering -- the industry does not deserve to be smeared by having some activist publish video of them. And in my opinion that description fits abortion, too.

    Judge William Orrick is an Obama appointee. Like all Obama judges, he legislates from the bench....and like all liberal progressives.....he worships at the altar of abortion. The reality is that arbitrary abortion is murder.....and the libs can't deal with that truth.

    - In US law, evidence obtained illegally cannot be presented. (All states?)
    - In English law such evidence can be presented but charges against the illegality are brought.

    This case seems to be the same , a pet liberal cause PP breaks the LAW in a very unethical fashion. Selling human aborted parts to the highest bidders. This practice gives an incentive to do very late term abortions and often the fetus becomes a baby as I takes its first breath before being killed and swiftly dismembered for profit.
    Then the parts are often delivered illegally by Fed express. The “Whistleblowers” here unveiling the criminal actions are charged with trespassing. What a f..ing joke.

    Yet today the Schitt show of an impeachment inquiry .They are protecting a gossiper passing on 2 Nd and third hand hearsay of no crime no bribery no nothing. If I said Adam Shitface killied a young man at the Standard Hotel in Los Angelos and owes a debt to have his actions covered up and his payment plan is to get rid of Trump at all costs.Who ever repeats this it becomes a fact and no one can cross examine, is a credible charge according to Shifty Bug 👀 Schitt.

    If this were a case about a stealth investigation into the church providing evidence the leadership knows full well the Bible is just the word of man and that they just seek funding and control, some here would change their opinion of the scenario.

    In the end, the jury should be able to see through the charade, and find the defendant guilty as charged. Privacy means nothing if it isn’t applied equally to all data, criminal, unsavory, personal, proprietary, irrelevant.

    The Chinese don’t believe in IP, and just steal our technology. This is no different. This guy is guilty. I hope it was worth it to him. He should pay a massive penalty and probably go to jail. The ends do not justify the means.

      I see your point. But. Where is the point of cutoff? Say the religious group is satanic and sacrificing people in their closed door meetings - let that go? In this case - possibly talking people in to late term abortion - to kill babies - so they can sell the parts? Not only that but doing it in a way that is more torturous to the baby so they can get more valuable parts to sell? And you also don't answer the point about police doing that same thing. They don't do undercover stings by going in and telling the potential criminal that they are actually police. I think it is a stretch to call baby murder/human body part sells the equivalent of theft of IP. Someone coming in under false pretenses to steal IP is fraud and embezzlement. Hacking networks and outright stealing IP is theft. I cannot go on the stand in defense of a murder and tell the court that that was my private business and be allowed to get away with it. If this is the standard, so long as people do their nefarious deeds in private - not only can they get away with it - but they can sue anyone for damages that make them look bad for using covert means to catch them in the act.

      Additionally - I think they are conflating the charges and the penalty. If he is guilty of trespass, tell me what damages the trespass caused? Trespass in and of itself causes no damage. Now, releasing the information, tearing up property, taking things, etc would be separate charges - but he is not charged with a separate charge only trespass. In this case they couldn't go after him for slander because their own words condemned them. Simple trespass does not justify a multi-hundred thousand dollar award. Maybe a couple hundred dollar fine.
